Here are some rules regarding residential CDCs that have changed in the last few months:
Landslide risk
Previously, landslide risk identified by a SEPP/LEP would rule out CDC only for the Low Rise Housing Diversity Code. Now the same rule applies to the Housing Code, Rural Code, Greenfield Code, and Inland Code as well.
Gutters & eaves over easements
Previously no building works were allowed over an easement with CDC. Now in the Housing Code and Code this rule has been relaxed to allow protruding eaves and gutters over an easement.
Balcony / deck / patio / terrace / verandah on small lot
Previously these outdoor works could not be done as CDC in the Housing Code and Greenfield Code on lots smaller than 300 sqm or less than 10m wide. Now they can be done on lots as small as 200 sqm with a width of at least 7m.
Minimum depth in Greenfield Code
Previously the Greenfield Code only applied to lots with a minimum depth of 25m. This restriction has been repealed.
Garages in Greenfield Code
An attached garage on a corner lot that is within 6m of a side or rear boundary is no longer limited to 18 sqm to be CDC in the Greenfield Code.
